2. PURPOSE

The provider, responsible for the Web site, provides users with this document to comply with the obligations under Law 34/2002 on Information Society and Electronic Commerce Services (LSSI-CE) as well as to inform all users of the Web site of the conditions of use of the Web site.

Everyone who accesses this Web site assumes the role of user, undertaking to observe and rigorously comply with the dispositions herein and any other applicable legal disposition.

The provider reserves the right to modify any type of information that may appear on the Web site with no obligation to pre-notify or inform the users, these obligations being understood as sufficient with the publication on the Web site of the provider.

3. INTELLECTUAL AND INDUSTRIAL PROPERTY

The Web site, including for information but not limitation, its programming, publishing, compiling and other elements necessary for its operation, the designs, logos, text and/or graphics, are the property of the provider or as relevant have specific licence or authorisation from the authors. All the contents of the Web site are duly protected by the intellectual and industrial property regulations as well as being registered in the relevant public registers.

Independently of the purpose for which they were intended, the total or partial reproduction, use, exploitation, distribution and commercialisation require in all cases the prior written authorisation of the provider. Any use not previously authorised by the provider will be considered a serious breach of the author’s intellectual or industrial property rights.

The designs, logos, text and/or graphics unconnected with the provider and that may appear on the Web site belong to their respective owners, these being responsible for any controversy that may arise regarding them. In all cases, the provider has their specific and prior authorisation.

The provider recognises their owners’ industrial and intellectual property rights, their sole mention or appearance on the Web site not implying the existence of any rights or liability of the provider on them nor its support, sponsorship or recommendation. The provider is fully committed to complying with Spanish regulations for the protection of personal data and guarantees full compliance with these obligations as well as the implementation of the security measures described in article 9 of Law 15/1999 on the Protection of Personal Data (LOPD) and in the regulations arising from the LOPD.

5. PRIVACY POLICY

In accordance with Organic Law 15/1999 on the Protection of Personal Data (LOPD) and its subsequent regulations, the organisation responsible for the Web site, in compliance with articles 5 and 6 of the LOPD, informs all users of the Web site who provide or will provide their person data that these will be included in a file duly registered with the Spanish Data Protection Agency.

Users who voluntarily provide their personal data by any of the contact means provided on this Web site specifically, freely and unequivocally accept that these data will be processed by the provider for the following purposes:

The provider informs and specifically guarantees users that their personal data will not be disclosed to third companies at any time and that whenever any type of disclosure of person data is to be made, the owners’ prior written, informed and unequivocal consent will be requested. All the data requested on the Web site are obligatory since they are needed to provide an optimal service for users. If not all the data are provided, the provider does not guarantee that the information and services provided will fully match their needs.

In all cases, the provider guarantees users their right to access, correction, cancellation, information and objection in the terms of current legislation. Likewise, the provider has taken all the technical and organisational measures necessary to guarantee the security and integrity of the personal data handled and to prevent its loss, alteration and/or access by unauthorised third parties.

Security

The Web site uses information security techniques generally accepted in the industry to prevent unauthorised access to the data. To achieve this, users/clients accept that the provider obtains the appropriate authentication data for access control.

6. LIABILITY

The provider does not accept any liability arising from the information published on its Web site when this information has been tempered with or entered by a third party unconnected with the provider.

It is possible that clients may be re-directed from the Web site to the contents of third-party Web sites. Given that the provider cannot always control the contents entered by third parties on their Web sites, it accepts no liability regarding these contents. In all cases, the provider states that it will immediately remove any contents that may contravene national or international legislation, public morals or order by immediately removing the re-direction to that Web site and reporting the contents in question to the relevant authorities.

The provider accepts no liability for the information and contents stored, for information but not as limitation, in forums, chats, blog generators, comments, social networks or any other medium that allows third parties to publish contents independently on the supplier’s Web site. However, in compliance with articles 11 and 16 of the LSSI-CE, the provider makes itself available to all users, authorities and security organisations to collaborate actively in the removal or, if relevant, blocking of all contents that could affect or contravene national or international legislation, the rights of third parties or public morals or order. If users consider that there are any contents on the Web site that could be so classified, they are asked to notify the Web site administrator immediately.

This Web site has been revised and tested to ensure that it functions correctly. In principle, its proper functioning for 365 days in the year, 24 hours a day can be guaranteed. However, the provider does not rule out the possibility that there may be certain programming errors or causes of force majeure, natural catastrophes, strikes or similar circumstances may arise that make access to the Web site impossible.

7. APPLICABLE LAW AND JURISDICTION

Spanish legislation will apply to resolve all controversies or questions related to this Web site or the activities undertaken on it, to which the parties specifically submit themselves, the law courts of Telde in Gran Canaria being competent to resolve all conflicts arising from or related to its use.
